Any time you "are trying to be nice" or "give them a break", not only do you undermine the legal foundations of your lease, you embolden the unethical tenants to move the boundary further in their favor.

Problem is there are probably 1000 lots or more for resale and the developer is still selling. 

No way he could have grown his rental business that quick or developed scale, by buying his own properties.
