@Carissa DiPietro there are actually quite a few legitimate reasons for landlords to not rent to people with ESA’s: if the animal is too big for the unit, if the animal causes a nuisance to other residents in the building, if the animal causes undo financial harm to the building owner, if the building owner is a small-time landlord with less than a certain number of properties, if the building owner lives in one of the units in the building and the building is less than 4 units, etc. the ESA rules aren’t just carte blanche anyone can have an ESA and landlords can’t say or do anything about it.

I think it is great for "nuisance claims," but never want to find myself in the position of getting hit with a law suit and having my only line of defense disappear.

You are still the owner and you will have to fix any big-ticket maintenance problem, but that rule will cut out 99% of the nuisance calls from a tenant and get the property out of your hair in a couple of years.

They're not likely to be around for 40 years; probably good for a year or two and then will move on anyway.If the police get called enough times they will tell the elderly lady to knock it off or she'll be charged for nuisance calls.

But it is a nuisance for tenants and they just need to deal with it ultimately, however if you have a obstinate tenant that is not working with you it may actually be better to wait for it to be vacant or work with them on a convenient time to do a showing.
