I understand the seller’s attorney’s position on that - since the contract already contains a clear assignment provision s/he wants to avoid an argument that the “and or assigns” language somehow changes or makes ambiguous the assignment provision.

In that case i would continue to tell them to clean up and be very specific. tell them exactly what you are worried about like, you might want to say “ take out the trash by Monday 5pm”, or “make sure you put trash in this container “ next do pest preventative treatments .

and it seems to me google campus abuts the landfill..probably not an issue for this person being on the other side of the freeway.. it is amazing how much gets dislosed in a CA transaction these days.. also while I got you on the line I had dinner with my buddy who has the container home building company you have a standing invite to tour on your next trip north.. !!!
