NAR does not create the law.

The only distinction between and "agent" and a "Realtor®" is that the latter is a member of the trade group known as the National Association of Realtors (NAR), while the former is not.  

Especially if you are with a broker that requires you to join NAR and your local state association.

Is the NAR lobbying every state to word the legislation this way or what?

NAR is very good at CYA legalese doublespeak. 

I suspect you're looking at those surveys put out by NAR and others about the return homeowners get from big improvements.
