The GC did go above and beyond the normal GC duties on the project, and he was absolutely vital to the project.

The servicer agreed to forebear the loan and to consider the borrowers for a modification.  

How can they sue on modifications they made?  

(I may have missed some vital detail)...

No changes in terms other than the interest.I'll find out more in a few days but in the mean time, I wonder if anyone here might be able to shed some light on this type of modification.
