The overflow drain /scupper should discharge somewhere that is visible so that if these are used you know that the main drain is clogged.

You cannot foreclose while the borrower is in BK and until it is discharged as there is what  is called a "Stay".

It was a long and arduous process, and if you want to know more about it some time, I'll tell you all about it, but long story short I am now in the process of being honorably discharged with a Master's in electrical engineering and readying myself to move back to California.

Discharge can't be paid by either the buyer or the seller"Alienation clause- The lender may want to prevent a future purchaser of the property from being able to assume the loan, particularly if the original interest rate is low.

While yeah, they would lose the rights to sue them upon discharge, the threat of filing BK doesn't work as much today as it might have in 2012.
