The lease says "Tenant will not assign this agreement or sublet any portion of the premises without prior written consent of the owner, any additional tenant over 4 occupying the unit shall pay an additional $250 / month"I spoke to the previous management company and they advised not adding everyone on the lease, I can ask what they think about using addendum.

I don't know if it's a good idea because of liability issues, but I have consent from the homeowner to do as I please to get the house sold.

Basically, it says - "Borrower understands the lender is the owner of the senior mortgage and obligations secured thereof"... and then... " if any interest in the property is subject to a junior mortgage without lenders express consent"...

In fact, there is an Assignment clause in the CA RPA (Residential Purchase Agreement) that requires you get consent from the seller in a separate written agreement to a specified assignee.

We added a Holding Over clause: "Should the Resident hold over on the Property after expiration of the term of this Agreement and with the consent of Management, the possession shall not be construed as a renewal for the same term, but shall be construed as a month to month tenancy in accordance with the terms hereof, as applicable, and Rental Rate shall be charged at a rate 50% higher than the Rental Rate as contained in Paragraph 3 hereinabove.
