A change of heart is not a sufficient reason to pretend the sale and recording did not occur.Finally, the failure of lawyers of the 'second' trustee/bene to timely record a Lis Pendens prior to the foreclosure sale suggests that if there is a flaw it is that such was not posted in the record and bidders are the ones that should have the option to cancel the purchase.

Also, what does this guy need to let it go....Does he need his whole 25K back or is he in apoistion to accept 20K (or less)....If there is spread between what he needs (plus the 3K remaining) and the value, there is certainly potential to wholesale.....Lets pretend for argument sake that the property is work 40K as is and that the guy would take 22K to walk away.
