A well run apartment complex should have leases that comply with laws in your area.  

Serve the appropriate notices to "comply or vacate."

Give them a specific deadline to respond and comply.

The ADU would still have to comply with the municipalities development requirements such as zoning, minimum lot size per DU, maximum lot coverage, parking spaces, etc.
