Have your attorney add some language about them forfeiting the split if they do not complete the job.

But if you do not issue 1099s, you also likely forfeit your right to deduct business overhead expenses, like marketing, education etc.

While off-market deals are great because you can usually buy at a discount you forfeit a lot of information you'd get with an actual listing.
