Thank you everyone for your input @Nicole Williamson I'll definitely have a separate discussion about the do's and dont's of smoking when and if we sign the lease.1) Would it be legal to take a separate deposit for smoke damage, like say $500, in case there is a damage to the carpet?

That's something I could consider doing - charge them for what's in the tank when they move in, have them deal directly with the oil company while they live there, and then reimburse them whats left when the move.Thanks @Al Williamson, I agree with getting myself out of the equation.

If you are in Williamson thet are much less likelyAn eviction in Texas in the vast majority of cases will takes less than 30 days including the Writ of Possession(If necessary).
