Matthew Hall Is the DOS clause actually spelled out in the mortgage or just implied because it's not assumable?

The note does not appear to have a DOS clause at all, it merely states that the loan is not assumable, but it does not specify what penalties, if any, would be imposed were the loan to be transferred in some way.

With the current "bailout system" we are merely trying to sustain the status quo, which penalizes those banking institutions that did not make bad decisions while at the same time rewarding poorly managed institutions by handing them taxpayer money.

Jason, here is what I have been advised: If your entity is on title, but you are named personally as the insurance policy holder, the insurance company could have a "reason" to not pay out claiming the owner was not the insured party.
