I have had a rental that had been heavely smoked in and I primed walls and ceilings and repainted and it was much better, but untill I cleaned and replaced some carpeting you could still smell it.

I spent about 20 hours cleaning and repainting to get it back the way it was when they rented it, what is a fair hourly rate to charge legally ?

Most people will plan on eventually repainting anyway.What I would do though, is keep a closer eye on your painting contractor, and be sure these issues are fixed before they leave next time.

If you repaint the walls, replace/deep clean the carpets, and clean up the yard, who's going to know there were ever pets there?

The kitchen has some older cabinets but they are still strong and good after a strip and repaint.

If it is necessary to repaint for a tenant that has only been in for a couple months, I might charge that to the deposit.I would hesitate to keep the entire deposit when I'm evicting a tenant for cause.
