My thought was:1 - I put the down payment and assume the mortgage.2 - Contractor (no skin in the game at this point) buys materials to complete the necessary upgrades3 - When it is done we sell the property and subtract the down payment, material cost, mortgage payments, utilities, settlement costs - and then whatever is left we split.

That conversation should give you a better idea of whether they intend to comply or hold over.Side Note: I will never allow a post settlement occupancy to accommodate a tenant - next time just schedule settlement for after their lease is over.

I called a real estate attorney and the consultation alone is $150, whereas the amount in question is “only” $1,190.I learned my lesson and made sure we had the security deposit accounted for at the next settlement, we actually avoided another $1200 repeat of the same.You can rest assured that this won’t happen again.

@Herbert Lewis most likely when you sign the contract with a 30-day settlement oh, you'll need to provide a 30-day eviction notice.

Actually to clarify, you won’t receive check directly, you will have to have 1031 attorney / settlement agent in the process who will receive check in name of you and will hold it for you, which they will use to pay down payment for the new property you are purchasing.
