Lots of sub2 buyers out there think that no harm can come to them if they let the property go to foreclosure.  

Sometimes, a deal isn't in the norm, reality isn't what it seems.If a seller is motivated to do something and fully understands the risk and pitfalls, then there is nothing wrong with creatively structured transactions, so long as :1. the intent is not seen as being predatory and is ethical; and2. the structure follows legal requirements; and 3. the consequences of risks taken are understood and can be managed to prevent any harm. 

The rainy season tends to be October to February, thus leaving yourself the potential of those gutters to be jammed pack and doing ore harm then good.

I plan on living in a 2 unit multi-family so I'm not trying to put myself in harms way.

I assume that as long as I don't require any additional security, there's no harm in simply transferring the deposit from them to me?
