In my opinion, it would just bring down the value, if there are now 2 of these, when the perception was that there was only 1.I think he'll do better just letting this one take the 'high price' if there is enough interest, and then put his out a few years from now, reminding people how much the first one sold for and getting lots of publicity then.That way this first one will set a precedent , either way

There is no general rule pertaining to expectation of return, & perception of risk.For me as an experienced investor, in lieu of a track record, I want more control, & to address the risks of the operator not performing as agreed.Evidence of success of the "strategy" is also important if you don't have a track record.I want the structure of the venture to motivate the behaviors needed for success.

Getting mired in an administrative law fight does not sound like a good time and def. not a formula for higher return on investment.I think maybe commercial master leases are less prone to scrutiny because of the different perception of the need to protect the public.
