Won't matter what his intent was, the reality is it's what it is.Your best defense will be making loans only to a business entity and get a clearly stated use of funds statement at closing as a condition for the loan. :)

The defense of the 2% rule is that it is a rule of thumb which allows you to reject a property that doesn't measure up based on the numbers.When you're looking at a fix and flip, the rent is not a prime consideration, many times the property is vacant and often uninhabitable.

Thus my right to sell it on to another.Point is, florida or otherwise, you do this enough times (2 or more a month or whatever) and not on a property you own yourself it's not much of a defense if called upon is it?

That means you have at minimum a $300,000 deductible on any lawsuit (excluding defense, that's $300,000 in actual damages awarded).I understand lay terms verses insurance terms.
