The person can request a hearing to fight the garnishment (which won't work for them once a judgment has been issued) or they can do nothing and their employer has to abide by the garnishment.It's a bit of a pain in the beginning, but worth it when the checks start rolling in later.

This mortgagee would actually be in third position according to your plan, not second. 1st Mortgage is original lender that was not satisfied and is the superior party in the Subject To. 2nd Mortgage is the property owner who you asked to finance the sale of the property. 3rd Mortgage is the other party who lends the difference.Perhaps you are trying to roll these positions into one with the idea of AITD, however they are still separate positions in title, are they?
