I'm a little surprised with the amount of people jumping to conclusions on this thread. I never clarified why I was evicting. The tenants haven't made a single on-time payment since moving in back in 2019. Their average payment was 20-30 days late. Additionally they refused to pay late fees. This went on month after month. Notices were sent out of an eviction coming BEFORE covid happened. We are only picking back up where we left off now that the courts opened back up. 

If this was a tenant who had a good track history of making payments I would be 100% for payment plans and compassion etc. But the endless lies and excuses get old after a while. 

I'd love to hear anyone's input if that makes me a "bad apple" lol.

@Todd Dexheimer - All Cozy offers me is a "credit". Which means next month might be less for them but there's no way to refund ie send back money to them that I can fine.

@Lynn McGeein  SC opened up evictions again starting on the 15th of May. 

I already stated in an email that I won't be accepting any partial payments. And SC states that's within my rights as a landlord to do. So I've decided to send the money back. I'm thinking certified check but I'm worried they'll see my name on the return label and not accept it. These tenants are digging in deep and trying anyway they can to prolong the process. 

Yesterday the owner of the property did a drive by at 10mph to make sure the house was still standing. The tenant came flying out of the house with a baseball bat in his hands. The owner hadn't even stopped the car or got out!

Thanks, that's the route I was leaning towards. Even if they don't deposit my check I can still show proof I mailed it back to them.

We begun an eviction on Monday with some tenants. I sent them an email explaining the process had started and that no partial payments will be accepted from this point forward. The next day they sent a few hundred bucks via Cozy (they owe $3,400). There's no way to stop this payment or refund it back through Cozy.

What should I do at this point. Send a certified check back to them requesting a signed receipt so I know they got it? Or since I have it in writing saying no partial payments are allowed will the court disregard their partial payment? I didn't want the court to dismiss the eviction because I "accepted" partial payment.

My wife and I door knocked last Saturday. A few days later we got a very receptive response from an owner who we had left a brochure at the door. They were interested in getting a cash offer. The next day all communication went dark before I was able to schedule a time to meet or give them an offer. The first lis pendens notice was on the 23rd of Dec. As far as I know there is no auction date scheduled yet.

Would you:

1. Go back after a week or so in person to follow up?

2. Give then space until they come back to us?

3. Other?

My fear is either scaring them away by being pushy or losing the deal to another wholesaler or foreclosure.
