Bottom line:  Debt incurred in anticipation of a bankruptcy filing is not dischargeable.  

So, AFTER the bankruptcy, those debts remain.  It is only right.

You need a lawyer.  Call George Flint Esq. in Dallas.  (The Flint Law Firm - see internet).  Very well respected.  He also owns a title company so he gets real estate.    Don't hesitate or blink at any necessary costs.  You are about to have bigger problems.

How about a JV with a tiny house builder. Buy a few units at their cost, rent them out and become an area dealer of the tiny houses. Sort of a bed & breakfast idea with two sources of cash flow. This also has the advantage that there is minimal development cost.

Contract forms and other necessary evils

I'm a member of the California Bar (based in God Bless Texas) but not offering legal advice here - just a word to the wise.  

Use an American Arbitration Association arbitration clause in any contract you use.  I use a binding arbitration clause with each party to bear their own costs.  That way a financially stronger party can't crush the weaker party in seeking "justice".

Lawsuits, disagreements, kerfuffles or whatever you want to call them are life sucking experiences with no winners.  Be nice.  Give the benefit of the doubt.  Walk away.  All tactics to save time & money.

Keep in mind, depending on a variety of facts, you may have to comply with the Patriot Act when wiring that money.  Be sure to come to grips with those requirements before you get under contract.  Don't want to miss any deadlines.  Bill (Esq.)
