I've seen a lot of growth predictions for Dayton that I hope remain true, especially around the Dragons baseball stadium downtown. There are several new businesses moving back into the downtown area which should draw a lot of college graduates into the city, and around the Oregon district.

 Thanks - happy to connect as we are looking to put some serious money to work in the area but everyone we talk to just gives me a bad vibe. Looking for experienced team where we can come in with the $ and have them renovate etc. Whether it be single family or small multifamily. Once I got some people lined up I was planning on taking a trip up there

As a title rep, my stance is of course to advise not to gamble your money and take on the risks yourself, BUT depending on your goals for the property, you may be safe in your decision. Is your plan to renovate and hold the properties as rentals long term? Are you looking to flip them soon after you purchase? If you're intending to purchase cash and refinance in the near future, you're guaranteed to have a title search run during the refinance, in which case I can understand not wanting to pay for a search twice in a short period, but understand that you as an individual don't have the same protections as the local government or bank handling a foreclosure or Sherriff sale. My 2 cents would be to not burn yourself and get stuck with an upside down purchase in an effort to save a couple hundred bucks.

Depending on the type of loan, you may want to have the borrower sign more than just a note and mortgage for a more complete paper trail in case they default. You should consider an Assignment of rents/ Deed in Lieu/ personal guaranty etc. But in terms of actually filing with the county, your mortgage will simply be recorded after the deed and first position mortgage.

Does the legal description match the parcel you signed a contract for? Unfortunately, no wrong doing was done if you signed an agreement to purchase a parcel of land, and that parcel alone is what was ran in the title search and deeded into your name. A lot of properties have empty lots that sit next to the parcel containing the home, especially in rural areas. The side lot may or may not have been purchased on the same deed by your seller, but unless your contract outlines both to be included in the sale, there really wouldn't be any legal action to take place, other than reconvening with the seller and having them sign a corrective deed to add the empty lot. That said, should someone at some point in the process have looked at the deed of record and noticed two legal descriptions/parcels and asked questions on why the second isn't being convened? Absolutely. But if this is the case, you shouldn't have any legal responsibility to pay tax on land you do not own, so for that reason, you have a claim to make with the state department.

Can you clarify what you mean by owning 100% of the business? Is the property titled to your personal names or an LLC?

How quick does the current owner need to sell the home? If they understand that groundwork has already been started, they likely don't want to re-start the process themselves. Get a CTA/ extension signed and keep marketing, or 'sweeten the pot' and offer to pay them an extra $500 for an extension, and deduct it from your expected release fee when you do find an end buyer

Depending on which road the property sits on in Mt. Oliver, it is definitely a stretch to call the area C class.. Surrounding neighborhoods like Allentown and Knoxville do have a lot of new businesses moving in, and from what I've read, the city of Pittsburgh has plans for revitalizing the area, but it could be several years away before the changes actually drive up the market. But, as with every area, people need places to live, and there is always opportunity for an investment if the price is right. You just need to do the market research for rentals on the block before you place your offer, and make sure to have a reputable property manager in place to enforce payments and upkeep.
