If you've already closed on the property you're buying you can't do a 1031 exchange; that has to in place prior to closing.

@Account Closed - My wife grew up in Nashport, myself in Granville.  We wanted to start some place where we were familiar, and where we are in Maryland is ridiculously expensive.  Newark is a great renters market; we've never had any problem renting ours out.  I'm looking at a few properties that are much bigger in size, but have no experience buying them so am trying to research commercial loans.  That's our next step...hopefully!!

Agreed...I'd start the process.  That will show your tenant you are serious and will not have your good nature taken advantage of.  If he gets the message and starts paying, no need to evict, but the tenant needs to know that sort of behavior will not be tolerated.

@Account Closed - my realtor manages his own properties and is managing our for us as well.  Right now, he's able to do it and does very well.  At some point (double-edged sword) we would like to compile enough of a portfolio where he can't handle it.  He's helped us in so many ways and managing is just one.  We've lucked out with a good start to our investing career and we owe it in part to him.

@Jennifer Beadles - how did you get started doing what you're doing?  Making contacts with the companies who work with people with developmental disabilities.  I worked for a company doing this exact thing in college and, now that I've started investing in real estate, have considered doing the same thing.

My wife is from the Zanesville area.  We have a few rentals in Newark...2 SFRs and a triplex.

Thank you all for the advice. To give a little more detail, each tenant has 1 spot, not assigned or anything as i'm not asking my manager to act as parking enforcement. The tenant has a car & a motorcycle. He doesn't use a spot for the motorcycle. The picture I got from my manager showed his bike actually parked in the neighboring vacant houses yard but problem tenant claimed it made it a tight fit to get into a spot. 

Problem child pays her rent on time but I have had issues. She has cussed my manager out more than once; flushed stuff down the toilet causing a plumbing bill; & constantly leaves cigarette butts on the ground outside despite being a non-smoking property. 

My plan is to, as suggested, give her options. I have talked to motorcycle man about keeping the parking spots clear. I'm going to explain that to her as well as infor her that threats & treating my manager like cap will not be tolerated. As her lease is up, I will gladly refund her deposit as long as she leaves the property in good condition.

Long story short, I have a tenant at a property in Ohio who is unhappy with how another tenant is parking.  My property manager has spoken with both tenants and tried to fix the situation.  In the midst of a profanity-laced tirade yesterday, the unhappy tenant said, "if you do not do something prepare to have this get a lot worse".  She also claimed she will hold onto her rent until the situation is resolved.  Her lease is up and she is on a month-to-month agreement now.  Any advice on how to delicately deal with this would be appreciated?  Our fear is when we go to evict her, she will tear the apartment up.  Any recourse to that if it does happen?
