Hi all, i guess alot pp stay home because CoVid19 but there are some still active. I really want you all to gelp me with the story of mine.
Here is story between me and ended buyer.i am a wholesaler and we got the vacant lot undercontract. All the county website and mls public record say it moblie home land. And home around nothing but moblie. I putted ads on craglist( selling moblie home lot)and my buyer found me from there. She called me and come to the lot a check and like the lot and want to buy it. I also told her the lot is for moblie home.I market it at 18k she offer 16k. Then i said i call you back when I discuss with the team. Then some other wholesaler told me that he give me full price for sure and he have buyer for that, and he told me to call my buyer and say someone offer me full price already. When i called her back, she was angry and upset. She told me i am not fair cause she call me first. She told you should give me counter offer, and she ok with full price and begged me to get the lot. But i can not accept it cause i sign contract with other wholesaler for 1 days. After oneday, other wholesaler have not found any buyer so i call
Her again. She said she still interested and she will put earnest money and sign the contract. After i send the contract for her. She read that and review and ask me alot of questions about contract. Finally she put down deposit(3k). Then at the closing day, she funded money through her phone at Friday evening. I should get my money and everything ready by monday.. early Monday, she call me and told me that she call the city and city dont want to put any movlie home there( if moblie home have to be 2018 moblie home and restriction the cost like built a new houses). She said she want to back out and want all the money back. I called the title escrow agent said her fund still not funded.( when the fund is not funded the buyer have the right to let the title send the money back for her).16k. She also ask 3k earnest money back.. purchase price 18 plus closing cost 1 total 19k. So title co refund her 16k. And title said if you want to get 3 k en money you should tell the seller to sign releases form for en money. Then she call me for that. I said we can not do that cause you back out last minute. She blame me cause i told her the lot for moblie home. She doesn’t know can not put old moblie have to be new moblie home or 1600 sqf brick house. She offered me 1k instead of getting her 3k. If i dont accept it, she will sue me. And she said does not matter how much i pay i will get that money back. She keep text me alot about that.
The title company sent me that 3 k now. My question is
If she sue, who will win.
If she win who will pay the lawyer for that?
My fault is told her that lot for moblie home( in fact,the lot for new moblie home and brick house)
But She have time to read contract( she saw and checked the properties 3 days before she sign contract)
The contract have all the buy property as-is do own due dilligent...)
