Hey all,

I am looking at a property that is going to the sheriff sale. I'm having a tough time evaluating the O & E report that was provided by the title company. Can anyone help me out with it? 

1. Mortgage dated September 30, 2013, executed by DP JR. and SP , husband and wife, to Wells Fargo Bank, N.A. for the principal sum of
$112,450.20 and interest thereon, if any, filed on October 3, 2013 and recorded in Book
161, page 8872.


2. Loan Modification Agreement (Mortgage) dated February 23, 2016, executed by and
between DP JR AND SP , and Wells Fargo Bank, N.A.,
filed on April 5, 2016 and recorded in Book 165 of Mortgages on page 1975.


3. Mortgage dated January 19, 2007, executed byDP JR AND SP, husband and wife, to MERS (Mortgage Electronic
Registration Systems Inc.) solely as nominee for Capital One Home Loans, LLC, lender,
for the principal sum of $88,450.00 and interest, filed on February 8, 2007 and recorded
in Book 150 of Mortgages on page 1107.

4. Subordination Agreement executed by and between Mortgage Electronic Registration
Systems, Inc. and Wells Fargo Bank, N.A., filed on October 3, 2013 and recorded in
Book 161 of Mortgages on page 8873.


5. Lis Pendens executed by Wells Fargo Bank, N.A., Plaintiff(s), versus, DP JR AND SP.: Any person in possession; Mortgage Electronic
Registration Systems, Inc., Defendant(s), dated January 26, 2017, filed January 30, 2017
and recorded in Book 10 of Lis Pendens on page 264.


6. Judgment filed January 26, 2017, against DP JR AND SP.
and Mortgage Electronic Registration Systems, Inc., in favor of Wells Fargo Bank, N.A.,
in the amount of $84,905.88, plus costs and interest, if any. File No. XXX XX-XX

I am thinking that the Subordination agreement  between WF and MERS moved the priority of the WF mortgage to the #1 priority even though the MERS as nominee for Capital One Home Loans was dated first. Is there anyway to verify this and what does it means MERS solely as nominee for Capital One Home Loans?

The Lis Pendens calls out Mortgage Electronics Registration systems but I am not sure if that mortgage gets wiped or not. Can pro's out there have an opinion?

I'm looking at selling a property of mine using an MLS flat fee service. Does anyone in Sioux Falls or South Dakota have any experience with this or any recommendations? I have found a few online but would like someone more local if possible.

Anyone have an example of their absentee list postcard? I'm looking for examples that you actually wrote and not the crappy free templates online that every one has received a hundred times.

I haven't worked on the formatting yet so I will be editing the headlines, colors, and font size. I planned on a postcard for the 1st round then followed by a postcard in the second.

I am working on writing my own copy for my DM postcard to absentee owners. What's everyone's thoughts on what I could do differently? I am open to criticism and am willing to add/remove any content as needed. This would be my first postcard and I want to keep it simple.

Did you inherit a property or are you a tired/ retiring landlord? Do the repairs needed to fix the property stress you out? Here are some of the problems you may be experiencing:

I have been working with an attorney on this. Her first recommendation was to attempt to reach out to them to see if they were interested in cash for keys agreement basically but it doesn't seem they are interested if they have not returned my calls. I definitely do not want to break any laws or piss off the people living there, I would just like them out.

I purchased a home at the sheriffs sale with the home still occupied. I have attempted to contact the previous owner by phone multiple times but have not been able to make contact. In South Dakota they have the 180 right of redemption law and it doesn't appear they are in any hurry to leave the residence before then.

Can I send them a letter to vacate while they are in still in the right of redemption phase? I was thinking of sending them this document:

I plan to offer either $1,000 or pay moving costs to vacate within 2 weeks, leave the property broom clean, undamaged condition, and sign over their right of redemption.

I would like them out of there ASAP and was hoping that a letter to vacate would maybe make them realize this is real and that they no longer own the home. Am I breaking any laws by telling them to vacate the property if they are in the right of redemption period?

I use ListSource to create my lists and unfortunately it appears in South Dakota, or at least my part, it does not pull equity information. Whenever I add this criteria, the results drop to 0. Has anyone else experienced this and is there any better work around besides using length of ownership criteria? 

Is it more of an information missing problem or what are some other websites to purchases lists from? This is a major criteria to find qualified leads and if I cannot access this, I'll be mailing many individuals with little or no equity .

Any advice would be appreciated!
