I'm not a lawyer and this isn't legal advice, just my two cents.  Technically, no.  You signed a contract and you gave him a certain time period to perform.  As long as they can perform within the time period, you are contractually obligated to sell or they can sue you for breach of contract.  But I would talk to the person your in contract to sell it to. Give them your reason for wanting to back out of the contract.  They want to work with you and make it easy for you.  Give them a chance to make it a win-win situation for everyone.

Michael, does an executor have to be assigned? or if one hasn't been assigned, can it be ANY family member?

I've used his "CRM" REI Pro. That system is pretty good for finding and sending out mailers. I wouldn't use him for much else. If you're looking for mentoring, go to Tom Krol at Wholesalers Inc. I hear nothing but great things. I'm just saving up for the 5k entry so I can start myself. check out his podcast and see if it's something you'd be interested in!

I have a bid in for a preforeclosure property going through a realtor.  I've already signed the papers for my offer.  Now I need to figure out a way to assign it.  Can I use C.A.R. Assignment of Agreement Addendum to assign my rights to the buyer?  I've seen the line that doesn't get me off the hook for responsibility, but once the buyer buys it, that pretty much ends my liability, right?

Hey everyone!  I know @Samuel Lynch was asking about buy and hold and everyone is of the consensus that it is a bad idea at this time in the market.  What about wholesaling or flipping?  I'm trying to get some contracts done and it seems to be extremely competitive as well.  In your opinions, do you think it is worth trying to get some flips or wholesale deals done here or should I start looking outside of CA and do some virtual stuff Joe Mcall style?  Thanks everyone, this has been a great thread!  Oh, veteran as well and in Vista.  I have had some houses under contract between here and LA but nothing that went to the closing table yet.

@Parker Cox @Jake Thompson @Joe Sherman Thank you guys for the advice!  This is why I love BP!  I'll call the both and see which one would be a better fit for me.  I plan on doing (hopefully) one a month through the end of this year.  I'll be ramping up my marketing and focusing on one or two strategies.

@Michael Halow I use REI Pro by Chriss Goff. They do a 30 day free trial of his CRM. It's pretty handy for leads and Comps. They also have an internal publishing tool that can send out post cards or letters on a one-time basis or a schedule. You can also use Rebo Gateway. That has a lot of leads and can be filtered down really specific. They can be downloaded in Excel and you can print them out yourself and send or a any of the several sites that do Yellow Letters or postcards.

This particular deal the owner received my post card and held on to it for about 2 months before calling me.  He moved to Texas and now he needs to sell his house as he has a new one and can't afford 2 mortgages.

Hey Bigger Pockets!  I'm looking for an investor friendly title company here in San Diego, CA.  If anyone knows one that can do a simultaneous close, that would be even better!  I have a contract I'm finalizing and I'd rather not use transactional funding to get it done and I don't want to assign it either.  

This will be my first deal in San Diego and looking for a recommendation!

Hi @Lloyd Mantong, I've since moved to San Diego so I've been focusing on the market down here.  Do you invest the San Diego area as well?  I've been focusing on Lease Options, but if something comes along for buy and hold, I'll make sure to give you a call if you're interested!
