Caleb, we always list the property, however in understanding James point of view, I think I'd rather not list it. We typically get the listing agreement signed the day we sign the p&s and I encourage the Realtor to list it at FIRESALE price.

The BPO agent absolutely looks at what the listing agent has come up with for a price from what I've seen so we have the listing agents we use plug in firesale price and then put the property contingent.

James, you're always a wealth of information!!

How do you justify why it's better to NOT have it listed? I've never even thought of that.

You both make a good point. The agents I'm working with I've brought deals too and they've brought to me. They have seen it all the way through from A-C and I guess when it comes down to it see the value in all of us working along side each other.

I'm not saying you couldn't question it on any side, but we have a form we have to fill out on the duel agency on the buy side which explains the agent's role. The form is state mandated. On the sell side IF my selling agent (who was my buying agent in the AB) brings an end buyer, I sign the same state form again. If they co-broke, the form isn't necessary.

I guess because this is the norm in my area (dual agency) I've never questioned it. Both states I work in right now have the same form that both the buyer and seller and agent sign for disclosure of representation.

Hi Justin,

We try to use the same agent all the way through...it's dual agency in my area, so they represent all around.

In doing all this and running into things this week, I realized that I could just propose to the Realtors that are giving me some slack that they are to only get the 5-6% on the lower transaction buy side, and we'll sell on the b-c side without them.

Maybe once they see getting 6% on 150,000 as opposed to 6% on 180,000 is a crap deal, then they will be happy to get the 6% on the back end.

Just working this all out somehow.

James, do Realtors bring you deals?
I have two Realtors that REALLY get my structure and in the past week brought me 3 deals....obviously I feel obligated to using them.

Also, most short sales we've done so far the lender is looking for the listing sheet. How do you handle that if you're not using a Realtor?

The realtors we've worked with thus far have never complained and seem to like the fact we are a sure thing.

We started marketing to new Realtors in January, and so far at least two have said they deserve 6% on the front and 6% on the back. We're sort of of the opinion they wouldn't even have the "back" if we didn't step in. A couple other new realtors aren't complaining, but I'm just not sure. So we've approached 4 total and 2 of the four seem to be shaking their heads at the structure.

So, I'm trying to determine why for some it's ok, and for others it's not.
