Their CPA is telling them they can declare it as part of their lifetime estate gift, however, they're still subject to a gift tax?

If you will now own the property as tenants in common upon added you to title.
You may be required to report the rental income if the property is a rental.
You may be required to report the income if the property is sold shortly thereafter.

You want to keep track of what your 'basis' is in the property as that will be important when you dispose of your interest in the property.

My CPA is saying the family member will incur a capital gain when quitclaiming the property to my name? 

As far as the gift tax, I'm understanding that it's just a form to file at the end of the year, however we don't actually get taxed on it until we exceed the lifetime exclusion?

This is interesting, how does the process work? Let's say they were to sell the property for $0, which is 100% equity. Isn't this process the same as putting myself on the title and having 100% equity?

Hi All! I have an family member that's willing to put me on title of his property, however, we don't know if there is any taxes that are due with this kind of transfer. It's paid off and we're thinking of just doing a quit claim deed. 

Does this trigger anything with the IRS?

This is an excellent point! What do you mean by "except for the purpose of enforcing rights that may have then accrued hereunder."

Also, is there any more clauses to that? I'm going to add that to my lease.

The rental provided for herein shall then be accounted for by and between Landlord and Tenant up to the time of such injury or destruction of the Premises, Tenant paying rentals up to such date and Landlord refunding rentals collected

  1. 1. uninhabitable, the Landlord shall have the option of either repairing such injured or damaged portion or terminating this Lease. In the event that Landlord exercises its right to repair such uninhabitable portion, the rental shall abate in the proportion that the injured parts bears to the whole Premises, and such part so injured shall be restored by Landlord as speedily as practicable, after which the full rent shall recommence and the Agreement continue according to its terms.

@Dave E. Thanks! I used the TEKS lath metal to wood screws, do you think those are okay ?

Also, do you have any specific brand or the actual name of the large screw/small lag bolt for the floating vanity?

@Paul Sandhu I'll try that! and correct metal stud into wood. I was using the "teks" screws.

I tried that however, the screw won't continue into the wood? @Paul Sandhu

Do you predrill or just point it at the stud and drill into the wood? @Paul Sandhu
