Good idea, Jason, thanks. According to the lease document (the owner used a generic lease agreement form), subletting is not allowed without Landlord's prior written consent.

If I were to kick out the subtenants on the grounds of trespassing, would they be able to complain that the subtenants who are renting bedroom #2 must therefore be kicked out, as well? Can I say that is not their business, and claim that I received prior written consent for those subtenants to live there?

But since the subtenants claim that they have paid rent (even if they haven't), doesn't that complicate things, in the definition of the word "trespass"? Then it becomes a game of subtenant's word vs. tenant's word of paying vs not paying.

I am managing a condo in Santa Ana, CA. In Santa Ana, it is common for the tenant to sublet the rooms out to other tenants. Although this is not technically legal, the police know the whole city does this and they turn a blind eye to it.

I never cared that my tenant did this, since she has been doing it for years and always pays the rent on time.

She recently alerted me of a problem. The subtenants (a family of 5) to whom she sublet a room is creating a really bad living situation for her by yelling, screaming, and generally harassing the tenant and her family. I went over to make peace last week, and the subtenants agreed to move out by this past Saturday.

The subtenants didn't move out on Saturday and now they are saying that they won't move out until the end of this month, which I now believe to mean that they won't move out until they are forced out by law.

My tenant did not have the subtenants sign a contract. And even worse, my tenant claims that the family did not pay her any money upon moving in. The subtenants claim that they paid her for a full month of rent.

What are my options at this point? The easy thing is to tell my tenant to handle it all herself and leave me out of it - after all, she caused the problem in the first place. But the owner whom I work for is telling me to help her resolve the problem.

Do I serve a 3 day notice to pay rent or quit? That is only good if they admit that they did not pay rent.

Do I serve a 30 day notice?

Either of these are only good if they are true tenants. In this case, since they did not sign any contract, and since they are illegal subtenants (in strict sense of the law), I don't know if any of these legal notices would be valid in court.

Does anyone have any ideas on what I can do?

I am thinking of getting a 203k loan to buy and fix up a house that I will live in. I have seen ads for "203k consultants" who will walk you through the process. Some are also general contractors who will do the rehab.

I already have a contractor that I would like to work with for the fix-up. If I can find a mortgage broker who is experienced with 203k loans, do I really need to hire a separate consultant?

Hi there,

I am helping out a broker as an assistant and I have an assignment to do a search on SoCal MLS (Tempo/Carets). I need to search for agents who fit certain criteria, such as:
Have sold properties within 4 miles of a specific address, in the past 12 months, etc.
Then I need to display their name, address, whether they were a buyers or listing agent, etc.

I know how to use the system to search for properties, but have never used it to search for agents. Can anyone offer any help?

Tom,

Thank you for sharing your experiences with us. Although you weren't able to get funded, it sounds like you were able to track down some really great deals. Did you try to shop those around to other investors?

The strategies that you briefly mentioned to find the 45 properties - that was quite a feat to be able to do that. Did you learn that from the program?

It sounds like the program's financing portion was a scam, but the education portion couldn't have been that bad if you were able to find so many properties that met those criteria.

I think he had some technical difficulties - the webinar didn't take place at the scheduled time. But I randomly went to the webinar address today and caught the second half of it (I'm positive it was pre recorded). It sounds like you get a lot of stuff for $997. Compared to the price of many other RE classes and materials, it's a pretty good price. I'm trying to figure out the different materials he offers. There's the $27 package and there is also one that is $400. And this one that he is selling on the webinar is $1000. I wonder if there is another one that he will try to upsell!

I don't know much about Josh Cantwell and I don't know if his system is good. If it is a good system, then the price of his package would definitely be worth it. It would be great if someone with experience with his system could chime in.

Any more news on this? I signed up for the webinar that is taking place this evening. I also saw that Josh Cantwell is selling his entire package of foreclosure training for $27 and was wondering if anyone has tried that out.

Thanks, everyone, for the warm welcome. I'm looking forward to buying my first investment property. But first I need to buy a place to live in! Then I'll start looking at investment properties. I'm looking at mobile homes since they seem like a lower risk way to get started. I've also been going to some seminars that pitch RE in other parts of the country that seem to produce better income than RE in Southern California. There are so many ways to invest in RE; I'll eventually find my niche.

Hi all,

I just joined the community and I'm looking forward to learning from people and hopefully helping out some others as I gain experience.

I'm looking to buy a primary residence as well as a separate investment property. My goal is to acquire at least one property by the end of the year. I'm interested in mobile homes, single family homes, and multifamily homes. I posted a question about how much to put down on my primary residence here, so if you have any advice, I would appreciate if you could post a reply there.
