Thanks for the response Marc! And good to hear things worked out in your situation too. Looking forward to wrapping ours up just as smoothly.  I'm consulting an attorney on Monday but I think it may be ok. The property was foreclosed on and the bank received the judgement awarding possession previously. Then they sold it to my brother in law, so assuming he has legal possession now. The prior owner vacated the property months ago and it's untenable as the water has been turned off for months too. Think we may be able to argue abandonment of personal property like you said and give them 30 days to pick up their stuff from a storage unit or it will be taken to the dump. T

@Jonathan G. How did everything go with your auction.com purchase and removing the prior owner's personal property? I have a similar situation up here in MD. The property was purchased through auction.com. The bank had gone thru the foreclosure process already and were the official owner at the time of settlement. However, the owner who was foreclosed on left their belongings (mostly clothes) in the property. And they still have the key, so we don't have access.

The property is untenable since the water has been turned off for months. Any thoughts on what we should do based on your experience? I plan to consult an eviction attorney, but would really like to get in there ASAP to start the rehab. I feel like since they have already vacated the property and live elsewhere, we could argue they've abandoned their personal property, put it in storage, and give them 30 days to pick it up or it's going to get tossed....

Great thread all. @Ray Slack I have a similar issues up in Harford County where the property was purchased at foreclosure. The bank was the prior owner since the courts awarded possession to the bank. The owner before that still has the key and has a lot of stuff in there (mostly clothes).  I've tried to do cash for keys with them but they're not responding. 

Waiting on a call back from my attorney, but curious if anyone has any updated info on this one?

Particularly what you were saying @Mindy Jensen with storing their personal property and giving them a deadline to remove? This would be much easier and cheaper than the eviction process. We would just need a locksmith to let us in and then change the locks.

Helping out my brother in law who just bought a foreclosure. The previous owner still has all their stuff in there but they are not physically living there. The water is turned off and they have an apartment somewhere else. I have been in touch with them. I know someone has certain rights (which would require an eviction) when they have been foreclosed on and they physically occupy the property, but this person just has their stuff there and they reside elsewhere. They said the bank was going to give them money for Cash 4 Keys but they never got around to getting all their stuff out of the property to get the money from the bank. 

Anyone have any idea what their rights are from similar experience? All responses come with the caveat "consult a local real estate attorney" :)

I'm looking to start my own property management company for rentals. The rent would pass directly through to the LLC that owns the properties. Should I form an LLC or a Corporation for the property management company? Thank you!

Thanks for the fast response! The only upside is I have spoken with their past property managers for the past few years and they said this company always pays on time and the family takes care of the property really well. It's also a multi million dollar company that gets a lot of federal contracts that last for several years in one area and then move on. I see what you're saying though which is why I am hesitant and being cautious. Hence this post.

Hi all, I have a potential tenant which is a company looking to place their employees in a home for a fixed period while they work on a contract in the area for a couple years. The occupants will be a family. I am having a representative from the company sign the lease and all the occupants sign the lease as well. Anyone see any issues with this? If the company stops making payments I can still evict the occupants because they're on the lease. Any thing in particular I should request from them? Any one have experience here? Any advice is appreciated!! Thanks Peter
