David, thanks for joining the discussion.  The solution that I was moving toward was to negotiate a deal for the sale of the house and have the probate attorney's fees deducted from the negotiated amount so that the seller would not have to pay them.  The deal could then go under contract and be finalized once the probate term for creditors was over.  The attorney would handle filing the probate and the seller's sales agreement for them.  According to everyone I spoke to, the property had to go through the probate process because it was in a will.   I'd be curious to know your take on this and if there was a better way of handling it.

So I did speak with a law firm today regarding the matter.  The matter will need to go through probate since it was in a will.  Here are the steps in Hillsborough County:

1.    Petition the court for administration of probate.  There is a $406 filing charge

2.    Advertise for creditors.  This is $80 to file notice to creditors.  Once filed it must remain on file for 90 days.

3.    Petition for the house as a homestead.

4.    Typically takes about 4 months for entire probate process.

This is strictly what I was told by a probate law firm in Tampa.  Not sure if there are any ways around this, but it did not sound like it based on my conversation with them.

Thanks David.  Do you happen to know if the rep (family member) need to get an attorney involved in the process or is it something they can handle if they open probate?

My neighbor recently passed and her relatives are trying to get the deed to her house so that they can sell it to me as an investment property.  They are listed in the will and the will is not being contested.  They have the original will and the notorized death certificate.  When they went to the courthouse in @Hillsborough County, FL in @Tampa, FL and @Brandon, FL location they were unable to get the deed transfered.  Does anyone know if this a @probate issue where an attorney would need to be involved or can it be handled directly with the county?  Any advice is appreciated.

Hello.  I just signed up for BiggerPockets today.  I've been listening to the BP podcast for a little over a month and plan on starting in real estate investing.  I am currently looking at an investment property in Riverview, FL outside of Tampa.  The situation is that a neighbor of mine passed away and I have spoke to her relatives regarding selling the property.  They are interested, but the deed is not currently in their name.  They have the original will and the notorized death certificate, but are having difficulties getting answers from the county.  I was wondering if anyone had any feedback on this for me?  I need to know if this can be handled at the courthouse or if it needs to be handled through an attorney?  

There are a couple of things that I will need to do as well on my end that I was seeking advice on as well. I will need to create an LLC to purchase the property. I will need a good (and reasonable) local real estate attorney. I will need a good local CPA that has experience with real estate and I will need financing. Any advice is appreciated
