WOOOOOW............... You guys too? This is too funny. I just found my tenants (who I am evicting) doing the same thing this past Thursday.

I go down in the basement to check on a couple things and I see an extension cord coming through the HVAC vent from their apartment to the outlet in the boiler room. I take a picture and un plug it.

I confront them about it and they try to change the subject and tell me the power was just shut off. I am almost sure it was cut off at least a week ago.

After I find this out I give them notice that I need to inspect the unit. Well I saw it this past Saturday and it is pretty trashed. I spoke with the village inspector this morning and he tells me he can probably make the apartment "Unfit for Human occupancy" since they have food actively rotting in the refrigerator. I am hoping this will allow me to get them out faster. The cook county sheriff is taking forever.

Is you question, can you file for eviction due to the tenant only making partial payments, or is your question can you accept a partial payment after filing the eviction?

Was just a my property and noticed an extension cord from the tenant's apartment who I am evicting. I was in the basement in the room were the boilers are kept. The extension cord was coming through a vent from the upstairs apartment. It was plugged into an outlet in the boiler room. I go up stairs and knock, and knock, listen to hustle and bustle, knock again........

Bottom line, the electric company cut off my tenant's electricity. My tenants told me they are not living their anymore, just getting the last of their things. How long will this continue. The sheriff was supposed to be there to evict them by tomorrow, but I have heard nothing from them.

Is this a multi unit or a single family home? I am asking because that may make your decision for you. Are you going to live in any of the units if it is multi family?

Why did the sheriff have to kick the door in? Were you not there to unlock the door for the Sheriff? The last thing I need is a kicked in door that will cost me more money.

I just got a call that I am under citation for excessive trash in the alley. Yes of course this is from the tenants being evicted. And someone set two of my trash cans on fire last week. I have a police report to prove it so maybe they will give me a break.

Yes definitely take Wendell's advice and go for the garnishment. My lawyer told me that you have to "post" a garnishment for 8 weeks at a time. I don't know how that factor's in with a collection agency but I would definitely go after the garnishment since you know he has a job.

Great news, My question is how did you find out? Did the sheriff contact you? My lawyer said they watch "the list" from the Sheriff's office every day so they will know when my eviction comes up.

However yesterday I get a call from another tenant in my building saying the sheriff was at the apartment of the tenants I am evicting but no one answered the door. I don't understand this as they (my tenants) have already been served and we have already been to court. My lawyer says the sheriff could have been there for another reason, but I still don't quite understand why.
