Disclaimer: I'm not an attorney so always consult a licensed attorney to be 100% certain. Although be sure to get an attorney that has worked with wholesalers, so you avoid the whole outright "wholesaling is illegal" nonsense.

With that in mind, while that is Kansas law, it's a rather standard clause that is commonly included in purchase and sales agreements. This clause typically means that the contract cannot be modified or assigned without all parties' written agreement.

In practical terms, this means that if you want to assign your rights under the contract to another party, you would need to obtain the written agreement of all other parties involved. This could involve modifying the contract to include an assignment clause or entering into a separate agreement specifically permitting the assignment.

It's important to note that the language of this clause may vary from contract to contract, so it's always a good idea to review the specific terms of your contract to understand how assignability works in your situation.

@Gary Leonard This is what I love about BP. I haven't logged in for a while because I've been so busy, but I love your post.

First of all, I'm thrilled to hear you had the success you had and that you're keeping it up. It took me two years to get out of my head and do a deal.

Second, I jumped on BP because, while I've watched some of Sean Terry's videos, I don't know too much about his reputation. And, let's face it, there are fake "gurus" out there scamming people's money.

What I also like about your post is that it shows that you can do it on your own, while it also admits that going through the course would have saved you time and probably would have made you more money.

I find it funny when people on BP make it seem like you're just wasting your money if you buy a course rather than watch hundreds of Youtube videos and read hundreds of posts -- although everyone should because you never know what little nugget you'll dig up.

You nailed it when you said that what your paying for when you buy a course is TIME.

Sure, there's a lot of amazing free content out there for just about any topic one can think of. But the problem is sifting through the coal to find the diamond.

One could spend years digging for diamonds and learning to craft them into a ring. Or they can go to a jewelry store and drop $10K to buy a beautiful diamond ring.

How many people who say one should only watch videos and read posts crafted their wedding rings?

There's only one thing that I disagree with you... I'm sure that he's not banking on one to fail just because he says that he'll give one's money back when they do a deal.

First of all, he's offering a 30-day money-back guarantee which a lot of other people don't offer because THEY ARE hedging their bets that most people won't take action.

They worry that they'll have a ton of refunds, or people will ask for a refund and keep the content.

And they're not wrong. There are plenty of unscrupulous people that do this.

But they fail to realize that if they offered a satisfaction guarantee, they'd make a lot more sales than they get scammed for.

Now with Sean, his offer to refund the purchase if one makes a deal is widely used because it gets people to take imperfect action. You'd be surprised how many people, even though they'll make a bunch of money, won't take action without a little prize like that.

It also serves another purpose... It reveals who the action-takers are. He's building a huge list of action-takers with whom he can do deals.

Plus, hardly any of the action-takers that qualify take people up on these offers. Joe McCall does this, and he told me only about 2% ask for their money back. Everyone else is simply happy with making money that they feel guilty asking for their money back.

Finally, you are right that most people won't take action. But it's shocking how large of a percentage of buyers won't ask for a refund even though they could because it's essentially admitting that they failed. And people hate to admit that.

I keep hearing about VA's but I've got no idea where to even start! Who are you getting for $6/hour?? Do you mind helping me out?

It's great that you're hiring a VA. It's the first hire you should make to free up time.

One of the best ways to hire VAs is to go after ex-pats living in Latin America. Here are some benefits:

1. Since they grew up in the US, they speak English well.
2. Mexico and Central America match time zones well with the West Coast, and South America and the Caribbean match up well with the East Coast.
3. Their cost of living is so much less.

For example, we have a rock star VA/Lead Manager just across the border that went to a private high school here in San Diego that we pay $8.50/hr which is the equivalent of $25/hr here.

And for the jobs that require more local support like Acquisitions Managers, we hire Americans.

I'm using Batchleads.io to skip trace houses but I'm not sure that it will work for raw land because raw land properties don't have a mailing address 75% of the time. All I have is the property owner's mailing address of the property owner but I wonder, if I'm skip tracing that mailing address, will I actually be tracing the owner of the land?

My guess is that the land owner probably also owns the mailing address property, because how many land owners are renters (I was because I was deeded some property but I'm probably in the minority), but I'm not certain.

So, any recommendations for skip tracing services that work well for land owners? Or a strategy that would work well?

First of all, a legal disclaimer: I'm not an attorney and this should not be taken as legal advice.

The laws in each state are different so it's always best to have a real estate attorney review any agreements.

Once you get a good agreement template, what's good in one state will often be all or mostly good in another. So, at least you won't have to fork out attorney fees to have them write a new contract. You'd only pay them to modify it.

Now, a lot of people ask this question because they don't have the cash to pay an attorney. If that's your situation, I'd say don't worry about it too much. Do a search for like "assignment contract template + your state" and use it until you get a deal done. Then you can hire an attorney to look it over and make sure it's 100% Kosher.

It's important to remember that an agreement written on a cocktail napkin is legally binding but, because it's not written by an attorney, could be hard to enforce if it violates a law. But, most sellers have zero legal experience and, even if the contract ended up not being legally enforceable, you could still use the contract to threaten legal action.

But again, use the template to get a deal done, use the profit to hire a lawyer, and then build from there.

Yes… they did send that email and you can see in PropStream that sold data is no longer available. For some reason they only sent it to their affiliates and not all users.

Absolutely. I guess they didn't want to scare off a bunch of customers but it also seems a little shady to not mention it to everyone.

They should also tell people if they are working on a plan to get the data back or why they think it's not important.

After a little research, I discovered that it's really only going to affect non-disclosure states of which I'm only affected by Texas.

I really like BatchLeads and use it a lot but up until recently, their lists weren't as good as Propstream. Now they are. So, as a longtime Propstream lover, I'm finding it difficult to stick around.

I actually wonder if it has something to do with the company that bought them? I don't remember Propstream hiding info like this before and only giving it out to affiliates.

This sounds completely wrong to me but I heard this rumor on Jamil Damji's Zoom meeting tonight as well. Jamil mentioned it and some people from BatchLeads said they confirmed it and that "it would be a boom to their business" but I still can't believe it.

Supposedly, Propstream sent out this email -- which I can't find in my inbox -- about how they're no longer able to offer all of the MLS data that they currently provide.

But this is the only evidence that I can find:

So I'm wondering if anyone else has received this message and if it's true?

I can't really believe that it is but...

@Freeman Schultz that is true but if you pull money out, you can put it into another property. When you do that, you're increasing your monthly cash flow. So now instead of having one door pay you $200/month, you might make slightly less on both because of the rates but you'll be making close to double.

Hey Joe, I know you asked for an agreement that can be e-signed but, while I couldn't find one that can be e-signed, I found this one for you from the State of Michigan which means that it's public information that you can use and turn into your own e-sign document. Just copy and paste the text, add the e-sign fields and you should be good to go.
