No i was not the lucky person.  I guess there is a lesson in there.   When i was newer to buying foreclosures i may have stuck around just to see;  this house has been in default for 20 months so postponement felt normal.   I do have some hope that it gets rescinded.  They post the results on a website and usually that is there for a few weeks; this time they posted the sale and then took the listing off the website completely.  I feel like this was an egregious error in the process.

Hi, I was just a bidder, and I am wondering what are the chances that this foreclosure sale gets rescinded in California.  The auction starts as normal.  The last bid is 100k over opening bid before the auctioneer gets a phone call to stop in the middle.  2 minutes later she gets another call and says it is postponed.   She says you are welcome to stay to get new date.  6 out of 7 leave since we know the drill and common postponements.  Turns out, auctioneer calls trustee again and they say go ahead with sale.  They start auction back at opening bid and the 1 person gets it for 100k less than the last bid.  There are multiple junior liens that would be in line to collect the excess funds they would have gotten in a proper auction.

Hello- I purchased a house at a foreclosure auction in California.   I likely will need to do an eviction.  The house was in the name of a husband and wife.   I think they are still married although the wife has moved out and the girlfriend has either moved in or spends the night a few times a week ( i am not sure).  Does this matter in anyway?

Yes, i researched the title myself and am comfortable that there are no other liens ahead of the lien that foreclosed.  I did not ever consider being on the hook for utilities so i will have to look into that.

Assuming that is right, then would it be the previous owner's obligation?  I really only care if it is my obligation or not and how the county will approach it.

Hi- I purchased a house at a trustee sale in September in California.  Property tax is current through June.  I assume the bank needs to pay the amount accrued up until the trustee deed being filed.  Is that right?   I imagine I would need to work with the county to get the billed pro-rated.  Does that happen automatically?

Thanks Ron.  Yes , I understand by rule no automatic stay for 3rd time.  I am just trying to understand how that actually plays out; the clerk processing the foreclosure filing makes that call or how does it work?

I am looking at buying a foreclosure at a trustee sale.  The homeowner has filed bankruptcy twice in the last 6 months.  As I understand it there would be no automatic stay if they file for a 3rd time in a year.  Is there a process that would delay the foreclosure to determine this or does the trustee sale move ahead and ignores the 3rd filing.  Futhermore, they had a bankruptcy discharged within 8 years, and this 2nd filing in a year is about to get thrown out as judge set a hearing to discuss this fact.  So the fact that the foreclosure was delayed even though clearly they had a discharge in 8 years makes me wonder if the foreclosure could be delayed even though no automatic stay after 3rd filing in a year since there is a process that takes time  to determine this.

Thanks.  It is chapter 13.   They submitted an emergency petition 40 minutes before original auction date.  Then they got an extension to submit further documents but in the end they did not submit those by the new deadline (14 days +14 day extension).   That along with not seeing a postponement of the 341 leads me to think they just are not pursing the BK anymore.

Hi- I am interested in buying a house at a foreclosure auction.  The process was stopped by a foreclosure filing.  The person filing BK did not submit their documents within 14 days and the 341 meeting was supposed to be today (i imagine they did not show).   I check on pacer and i have not seen anything else filed for this.  How long would it take for this to get dismissed if all above is true?
