Bankruptcy Automatic Stay - Foreclosure
I am looking at buying a foreclosure at a trustee sale. The homeowner has filed bankruptcy twice in the last 6 months. As I understand it there would be no automatic stay if they file for a 3rd time in a year. Is there a process that would delay the foreclosure to determine this or does the trustee sale move ahead and ignores the 3rd filing. Futhermore, they had a bankruptcy discharged within 8 years, and this 2nd filing in a year is about to get thrown out as judge set a hearing to discuss this fact. So the fact that the foreclosure was delayed even though clearly they had a discharge in 8 years makes me wonder if the foreclosure could be delayed even though no automatic stay after 3rd filing in a year since there is a process that takes time to determine this.
