I'd be very concerned about the fact that a 2 year old apartment building .5 miles away is only 75-80% full. Of course there could be extenuating circumstances, but it sounds like the market won't support more apartments.

Here's another vote to give her notice to vacate...

And by the way, when these things happen don't intervene unless it's for some reason fairly serious.  The more you intervene the more the complainers will complain!  

The tricky thing is to find that sweet spot of intervention that protects your interests without encouraging tenants to complain about each other.  But it sounds like you have a pretty good grasp on it already.

Just an obscure point of order...

Virginia law requires prepaid rent to be maintained in a separate account akin to security deposits.  I don't know how anyone would ever know the difference, or if your state has a similar requirement, but thought it was worth mentioning.

@Sam Valme, in VA you're required to be (or work under the supervision of) a licensed broker to manage property for others. There are a few exceptions: if you are a W2 employee of the owner, related by blood or marriage, and maybe some others.

A tenant without a written lease is a huge can of worms. Tell her she cannot stay without signing a lease. In VA we post communications of such importance on the "main door of the residence" but you should check your own state's laws. Give her a deadline, and if she doesn't comply begin the eviction process that day. Otherwise she will continue to control YOUR property like she is doing now.

@Matthew Hicks, I can only tell you what I would do... and it's not good news.  In my mind a quote is a quote, and the person/company giving the quote is responsible for the due diligence required to give an accurate quote.  I would eat the extra expense and enjoy knowing that my reputation will be enhanced rather than denigrated because I didn't honor my quote.

It's tough, but sometimes lessons are expensive.
