thank you @Steve Babiak I believe the last borrower before the bank closed on them had rented the place out but I will doublecheck to make sure they do not fall into the protecting tenants at foreclosure act.

thank you @Jeff West that is very good advice. It makes sense to be nice and not talk about money and let them make the first move. I was planning to offer money first . Great advice.I will shoot you an email later when I get closer to that time thanks again.

Thank you @Sean Brooks yes it's exactly that it was foreclosed on the borrower  and they had Leased it out to the tenant but agreement is over from what I understand they just have not move out. Makes total sense that the bank has problems moving them out so I will have problems too.

I did not know about eviction centers ,I will follow that to see where it takes me.

I have in my analyzes put $10k for the eviction ,and prefer to exchange for key as this could take a lot less time than going through court process. 

Hi I'm in the process of putting an offer on  a foreclosed house from bank but they cannot guarantee the tenants eviction. Any advice?this is in Southern California.

that is a great job. It shows that there are many many different deals out there well done. And different sellers look for different dollar value for the property than any of us as investors.
