 yeah that's true. maybe I'll look into that. I've met some people recently that do that stuff. Maybe I can get a short loan with low $ in from me where I'm not gouged on points :)

I understand what you do, that's not what I'm looking for. I have a place that's by owner for $415k. I know its $500k+ on the open market. But if I can't find the open market, then I'm forced to sell to a neighbor who really wants to be in there and will pay the $ or have to take a big hit and sell to someone like you who wants to make a profit. I wanted to offer him the $415k, lock up the deal and then market it for 1-2 weeks and get $500k-$515k and make $85k-$100k selling it to a retail buyer. 

I guess its not possible since I can't legally/ethically market his home for sale when he has agreed not to list and thinks I'm buying the place. Bummer.

I guess that's where I struggle..I won't be able to get true market value if I can't list it and do my big open houses. 

Otherwise I just need to find a buyer that will pay me a whole sale fee?

Pretty simple:

Seller wants $X which is under valued. I'm a realtor, I know its worth more. seller won't list. "just bring me a buyer". Ok, here is $X from me, I'll 'buy it'. 15 day as-is, I put it up on the MLS, hold my open house, get 4-5 offers from realtors, flip the contract for $Y. Seller gets his $X, I get the difference between $X & $Y. Way more than a commission, and I get paid within that 15 days since I'm not seeing it through to closing.

How do I make this happen is what I'm asking the forum. Standard FL AS IS contract, check the 'may assign and be released from liability' box, then what? How do I get the difference? Or how do I make sure I get the difference?

Hello,

As a realtor, I come across deals off market and I don't always have the funds to buy them myself. These people just want 'their number' and don't want it on the market. So I'd like to 'buy' their home, market it for the 15 day inspection period, find a buyer willing to pay more and have the difference go to me in lieu of a commission since they aren't listing with me.

Anyone have experience with this? We're not talking pennies either, potentially $50k-$75k if I can get access to the home and do my big open house. I more than likely would be flipping to a Realtor represented buyer. Does that make it difficult? More than likely a cash buyer, not worried about financing. I will have checked the 'may assign and be released' box on the contract.

@Wayne Brooks - I'm aware of the Sunbiz rules. What I'm saying is title is owned to property in an inactive LLC. What legal rights do they have anymore to the property if their entity is dissolved? (was dissolved many years ago too)

I don't know if this is a dumb question or not, but I've seen properties in Miami/Broward owned by LLCs that if you look them up on Sunbiz, the LLC is dissolved for non payment, non filing of annual report, etc.

My question is - now what? Can someone just re-activate the LLC and take it? How could this person legally sell their property at time of closing when the LLC is inactive? What legal ramifications do owners face?

Was doing some surfing tonight and just saw that 2 of my landlords have dissolved LLCs and I'm worried about what can come in the future if they don't fix it quick.

Isn't EIDL all gone? We applied back in April and it ran out, got re-upped, and then ran out again before May.

So how much did you actually make after expenses? was the sale price before closing costs (I'm assuming 7.5%-8% after realor and closing costs) - $10k?
