Post: Pipes Froze - Am I On The Hook?

Airbnb guests do not have to notify you they are bringing an ESA or Service Animal. You can, however, charge for the mess they leave. Even if it's a room in your home or your full home you're renting out and you're deathly allergic to animals, you cannot refuse them.

We go over this thoroughly at move in -- you notice the baseboards are clean? The return vents, oven, fridge, behind the toilet, etc. and go through the entire house. We show them the list of our Move Out Procedures and all of these cleaning tasks are noted on it. Then they initial that they received it in this condition and will return it as such or pay for the cost to do so.

You can put anything you'd like in the lease about it but you would have to stand in a courtroom before a judge and *prove* that tenant was smoking it. Do you have video of them smoking it? Did you search inside and have pics of the items? I'm not a detective nor am I a lawyer so I'll put it in the lease for the owners but at the end of the day, it's completely unenforceable.

Then you haven't met a good PM. We (my client) went through a couple and I vetted some for him but we realized they were crap so we started our own company and he has 100% peace of mind with my management. The issue is to find one that you can trust.

As much as it sucks for owners, PMs, and other tenants, just because we are LL does NOT mean we can suddenly magically control other people's behavior and get them to do something. I love it when tenant scall and tell me to MAKE the neighbor turn down the music. I always ask, "What exactly do you think I can do other than what you did, ask them to turn it down?" They always respond with, "MAKE them!" But have no answer for how to do that. LOL All we can do is make them aware of the consequences. Can you force her to turn the heat on? No. But you can notify her that she's responsible for all damages caused by freezing/burst pipes. Make dang sure your insurance policy will cover it and ensure that you're protected. There's nothing more you can do at this point other than follow the steps for eviction.

Don't try to name every scenario, just state that if the clog isn't caused by roots or a collapsed sewer line then tenant will be charged for cost + admin fee.

It doesn't cost the landlord, all fees are paid by the either the tenant or the prospective tenant. The cost is as low as $20 per pet profile. If the tenant has an actual "Service Dog (animal)" they pay nothing.

"I don't think we can "require" that tenants go through them? " Really people?! You are operating a business and you don't know what you can legally do or not do? Either get a property manager to take over, hire a lawyer or get an education.

It literally took me less than 5 minutes to search the KS Attorney General website for any law saying you can't do this. Guess what? There is no law that say you can't. Just for good measure, I called the Kansas legal service, pretended to be a tenant that was being discriminated against. I had an ESA letter and the LL refused it and said I had to use petscreening.com. Guess what? The landlord can do this.



I did contact our attorney yesterday and we can NOT require they go through petscreening.com in Kansas. We can ask them to do so but all they have to do is present the document to us, they do not have to use another service. 


 My understanding is that if you require ALL applicants to go through petscreening, regardless if they own any animals or not, then this becomes a part of your screening process like running a credit check. In this case ESA owners are not singled out and go through petscreening like all other applicants. 


 Interesting. I'll check with another attorney we use sometimes.
