I recently purchased a duplex. One unit was vacant, one unit has an existing tenant. I've already put the existing tenant into a new lease so that is not the issue. The issue I have is with the former lease. I was under the assumption that I should inherit the deposit ($1100) and the pet deposit ($800). I never received the $1100 at closing but my realtor was able to get that within a couple of days from the seller. I still have not received the pet deposit, and they are claiming that it is non refundable, so they should get to keep it. They are also claiming they over paid me when they gave me the $1100. Here is the email they sent to my realtor:

I recently purchased a duplex property. I notified the existing tenants that rents would be going up do to them being grossly under priced. Both tenants had leases thru Aug 31st. Both tenants gave notice they were moving out. The lower unit tenant was completely out by Aug 12th. We let them know their full deposit would be given the day of the final walk thru. This seemed to motivate lower unit tenant. His departure went smooth & I was able to rehab & get lower unit rent ready & have it rented Sept 1. The upper tenant has been somewhat of a pain. They were asking to leave some things there until their house is ready to move in to. They asked if I would want to buy the portable dishwasher they had. They began taking up both off street parking spots even though they knew i was using one to haul in supplies to fix up the lower unit. Anyway, they decided to pack everything up and have their final walk thru yesterday. Everything went ok. Then last night i noticed something odd. All the flowers that were planted in the front yard were gone. I thought they were kinda petty when they took all the light bulbs out of the unit, but taking the planted flowers as well, that took it to a new level for me. Later that night I was throwing out some garbage, opened up the bin, and low and behold, there were all the flowers laying in the garbage! hahahaha. So apparently, just for spite they dug up the flowers, and chucked em in the garbage. hahahahaha. So, just for fun I grabbed a couple of them and replanted them so when they drive by (and you know they will) they can see their flowers in all their blooming glory!

I'm still going to try make it there today if even for just a brief time. I have a rehab on a duplex i'm in the middle of & trying to get ready by Sept 1.

I found all my deals on the MLS. I've been watching it like a hawk for the last few months. Anytime a new duplex comes out I'm finding out i go do a drive by contact listing agent, basically find out as much as i can. I'm starting to get some leads out there. I have met a few people that have property that they may be parting with soon. I've told them to put me on their short list & we'll see if we can make things work.

I can do either of those days.

Also I will definitely be requesting a lower price considering that the boiler is shot and the windows also need replacing.

Current situation:

I agreed to purchase a property "contingent upon building inspection."  Yesterday I had said building inspection. The units were to be empty upon inspection. (2-3 hours)  While my inspection guy was there doing what he does, the lower unit tenant came home drunk (3:30 in the afternoon) and proceeded to pass out in one of the rooms. During this time he awoke a couple times, went outside, would cuss & swear for a bit, then go back into the room & pass out. I met my inspection guy at 5:00pm tenant was currently still passed out. We did a walk thru of  the upstairs & outside. When it came to look at the lower unit, the tenant had locked us out. Our realtor got the key from the lock box & we were able to gain access. During the lower walk thru, tenant awoke and mumbled some stuff at us and then passed out again. We finished inspection & went outside to discuss. During this time upper tenant came home & I spoke with her. She said she's had to call the police numerous times about the lower tenant whom i also found out is also not even on the lease, he's just a boyfriend of the female on the lease, but she's currently in jail on drug charges. She also said the current landlord has done nothing about these tenants either.

So can I state in revised purchase agreement that the "lower unit must be vacated upon closing"??? Their current lease is not up until Feb 1 2018.

I need these people out or there will be no deal. Any advice is appreciated.
