Thank you all for your feedback.  Discussing it with my PM & lawyer, and will look into not renewing their lease and getting them out.

For those who asked, the tenants are making racist comments to the PM about tenants who are Mexicans.  Referring to them as "those Mexicans, those people, they don't even speak English, they are all filthy and drunks...," and making claims about the Mexican tenants without any evidence or vallidity.  Claiming they have bedbugs, and that they know those people have bed bugs by just the way they live (pest control stated there are no evidence of bedbugs).  

The husband was complaining to the PM about the "Mexicans" how they was drunk and was in the basement on the utilities side (his apartment is on the other side of the basement).  Apparently he didn't like the tenant going into the utililites side, and that was when he said a comment about how he didn't like it and he can get his gun and shooting "them".

They are on month to month so we can give them notice to end their lease of course.  The woman keeps on mentioning that she knows her rights and that she used to be a case worker, which I am not sure what she's insinuating.  

Planning to give them a letter to let them know that we do not tolerate racist remarks and threatening comments.  We assumed these tenants from the previous owners.  Not sure if we can update the lease to state no weapons/guns are allowed in the rental property.  I've read several publications but some say yes, and others say that it may infringe on te 2nd amendment to bear arms.....

Checking with a lawyer to see what my options are but figured I go to BP to see if anyone has dealt with these issues.

I have tenants who are racist to other tenants who live on the property.  Both tenants has made racist comments about the other tenants to my property manager when referring to the other tenants.  One of the tenant went as far as to say he's going to get his gun and shoot them.  When the property manager told him he can't say things like that, he plays it off saying he can say whatever he wants but he doesn't always mean it.  What can we do?

UniteCT has contacted me that they can pay for my tenant's May rent.  I was planning to file a notice to quit for lapse of time and for them to vacate by 5/31.  If I accept UniteCT payment, would that affect me filing the notice to quit and eviction process if needed?

Hi. Looking for help for a friend who had his earnest money deposit (EMD) kept by the seller's attorney. He backed out of a MF property because he didn't felt that the seller and the seller's attorney was shady, and he did not trust that what he's been told about the property is true. The seller and his attorney misrepresent the actual sec. deposit for one of the tenants, and was not going to transfer it over to the buyer. The buyer's agent had to show MF disclosure and seller's agent communication before the seller side agreed to turn it over. The selling agent was part of the selling LLC that own the property, and she misrepresent some info on the property, and this became apparent prior to closing. The seller's agent was actually let go from the broker's office. The seller and the attorney are upset when the buyer backed out due to them not being truthful in the purchase, and they will not give the buyer back his sec. deposit. The buyer's attorney basically said he can't do anything except file a small claim suit for the money. We are in CT. Can anyone advise on what he can do?

Tom S. That's really good for commercial loan!  Any way I can get your info so I can get some info on the company you use?

Regarding personal guarantee, I haven't run into any lender that asked for it until recently, and now I am wondering if it will be required for most to get a better rate.  I worked with one commercial lender already on the property and got 6.125%, and am looking for better rates thus my search.

Loan is for 130 - 250K.  

Bill William, I agree! Just wasn't sure if that is the norm so I will continue looking at other lenders.

Hi.  I just had a commercial lender ask if I will personally guarantee the loan, and am not sure if this is normal?  Should I be saying yes, or is this to risky and I should say no?  Thanks. Kim
