Post: Split the property for sale

I have a farm house on 3.5 acres. I have put the property on market for the last few weeks but i didn't get any showing. The property is expensive, so I am thinking about splitting the property into  3 pieces. I can sell the house on 1.5 acres and 2 piece of 1 acres land individually. 

What do i have to do to split the property? The property is currently only have 1 tax id.

We would like to sell a property in Manvel, Tx. And we need to have an appraisal for farm/ranch property. Please let me know if you have any recommendation.

I need an appraisal to measure the sqrt and determine market value for one property in Houston. Do you have any recommended appraisal?

@Jay Hinrichs : When is the cut off time that you would buy from the owner? Do you buy the property from the owner on the auction date too? I am just curious the deadline that mortgage company would accept the owner to bring the loan to current.

@Jay Hinrichs: Do you usually paid off their mortgage at closing too? Or you buy the property with SubjectTo?


@Jay Hinrichs: If you prepare your own deeds and notarized them by yourself then  I guess you will not go through the title company. What can you do to prevent the owner from create another deed of trust just few days before you sign the contract? So the new deed of trust would be in the first position. What can you do to protect yourself?

@Wayne Brooks: Should i hire an attorney? Or should i depend on the bank's attorney? Because i am not sure what value will my attorney bring to the table? The deed is already record in my name. I don't think they paid off the loan neither. You think the other 2 items are irrelevant? I don't know why the attorney would use them if they are not a big deal and use them to reverse the sale when the deed is already recorded.

Hi,

We have bought a property from the foreclosure sale couple months ago. After the previous owner received our vacate notice, she hired an attorney to sue us, trustee and the bank. We have talked to trustee but they didn't aware of the lawsuit. They said their lawyer would give us a call but they didn't contact us so far. We talked to the previous owner's lawyer, and he said there are 3 reasons for the lawsuit:

1) The previous owner lives on a different property, and the bank/trustee didn't send the notice to her address.

2) She paid the loan off in 2016.

3) She is not required for escrow account but bank charged her one.

What should we do in this situation? Should we hire our own attorney to represent this case? or should we depend on the bank's attorney.

Can you please let me know how does your 1st owner finance works? You bought a property and refinance for 125K under your name, and then you sold your property and put a Deed of Trust for 157K. So, you still have a loan balance of 125K under your name. Is that correct? Did your mortgage is OK with it? Do you concern with Due on Sale clause?

Thank you for your feedback. I will wait for my HELOC application to be completed before apply for refiance.
