Hi,

I have applied HELOC for my primary residence. Should I wait for the HELOC application process to be completed before applying for refinance on my rental property? Or Is this OK to apply both HELOC for primary and refinance on my rental at the same time?

Hi,

I am interested to buy one property in foreclosure in Texas. This property has a mechanic lien filed before the deed of trust, but the deed of trust mentioned that "Deed of Trust is granted by the Borrower(s) to secure Borrower indebtedness to Lender, the indebtedness secured hereby is in renewal and extension but not in extinguishment of that indebtedness .. of the mechanic lien".

Now, the bank uses the deed of trust to foreclose on the property. Does it mean the deed of trust also include "renew and extend" the mechanic lien, and the mechanic lien exists at the foreclosure? And the buyer doesn't have to pay additional cash to remove the mechanic lien?

Hi,

I bought a small building (1200 sqft) for cash one year ago. I have leased this building to a commercial tenant, and i would like to refinance or HELOC for this building. This building is worth around 150K. I would like to know what are my best options:

1) Since this building is used for investment, so can i still do HELOC on this building?

2) Can i apply a residential loan for this building since it is small likes a home? Or do i have to apply a commercial loan since this building is zoning to commercial and used as commercial?

@Tom Gimer: Thank you. I was hoping to get some of the settlement since the pipeline company are currently working on the land and it will take them 1 more year to complete the construction.

@Tom Gimer: if the easement was recorded after the lender's deed of trust. Does that mean the easement is also going to be foreclosed? And we would be able to renegotiate the new term?

@Tom Gimer: It's hard to find out the term. The agreement only mentioned about 10$ and other valuable consideration. The right-of-way agreement for construction is only for 2 years. But, it is permanent easement & right of way.

There is a foreclosure property, and the owner signed the right-of-way agreement with the pipeline company last year to allow the pipeline company to install the pipeline on the property. If I buy the property at the foreclosure sale. Do i need to honor right-of-way agreement? Can i re-negotiate the term?

There is a motivated seller contacted me today. He has a commercial property, which is scheduled to be foreclosed in the next few days. He has some equity in the property, and he wants me to buy his property and sell the property back to him via owner finance. What should i do? I like the property, and i think this property has the potential to appreciate in value. Should i attempt to buy the property and lease it to him? Or should i buy the property and resell the property back to him? If I resell the property, how should i charge him?

Is "Tax Liens Contract" the same as "Transferred tax lien"? And does "Tax Liens Contract" get wiped out at Trustee foreclosure or not?
