Yes, the worse they can say is no, but at least you're in their mind. and you can just follow up every week or so

If they asked for POF and signing a waiver, you are probably the top option and they're just trying to continue the bidding war.

 Is there earnest money down? You should be able to keep it without any issues. You can also sue for performance but that’s a tough road to go down.

Just make sure it's a location that you're okay living in. It doesn't have to be a homerun deal in the first year.
