This presentation will teach fair use of MassCourts.org, the public record of summary process (aka eviction) and housing-related small claims lawsuits in Massachusetts. Landlords can and should use this information to help score rental applications, screen tenants, and ensure that every resident will follow the rules and contribute to a happy and healthy community. We will review:

Reasons why renters can appear in MassCourts.org other than being a bad renter.

How renters might be screening landlords with MassCourts.org, too.

How MassLandlords' objective, point-based applicant qualifier helps clean housing history overcome bad credit or other barriers.

A full tutorial on reading and understanding dockets including summary process terminology, address matching and fair housing.

We will also review the proposal to seal court records (HOMES Act) and explain how this fosters secrecy and enables petty corruption, while hindering proper tenant screening and sociology research into the causes of eviction.

Attendees will leave knowing how to fairly screen tenants using information in the public records.

Part of this presentation will be given by attorney Adam Sherwin. Adam is an experienced real estate litigator with years of experience representing landlords, property owners, and other real estate professionals. He has extensive experience litigating real estate disputes before judges and juries and has obtained favorable decisions from the Massachusetts Appeals Court and District Court Appellate Division. He is also a long-time crash course instructor at the Cambridge headquarters and over zoom.

This presentation will teach the basics of water submetering. Why we should, what it costs, and how to bill compliantly. In particular, we will review:

Motivating horror stories of tenant water usage gone bad
Basic cost/benefit analysis and ROI
When to install meters
Which types of meters are available
Upgrading or verifying low-flow fixtures
How to get the town or city to sign off
The legal framework for metering
The MassLandlords invoice which facilitates monthly or quarterly billing
Frequently asked questions for submetering
Attendees will leave knowing that water submetering is a good goal to work towards, and knowing the next steps to take when ready.

Part of this presentation will be given by Doug Quattrochi, Executive Director, MassLandlords, Inc. Doug was a founding member of MassLandlords in 2013. He became the association's first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to approximately 2,500 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a staggered and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.

Post: Housing Court Case Law Update

The Housing Court will brief the SJC’s decision in Dacey v. Burgess (SJC 13286). In Dacey, the SJC concluded that the landlord could enforce the agreement that she reached with the tenant through mediation and recover possession of the leased premises, even though the underlying case was not brought as a summary process action.

In keeping with the court's tradition of public service and fairness, court staff will invite attendees to provide feedback on recent experiences. Note that we distinguish between procedural feedback and case law. For instance, we can share feedback on the process of entering a zoom hearing, but not about why a judge did or did not decide the way we wanted in a case.

Discussing active cases will not be allowed. This event will not be recorded.

Part of this presentation will be given by Benjamin Adeyinka, Deputy Court Administrator, Housing Court. In 2002, Ben started a career in banking and real estate. In 2009, he began working with Orlans Moran, PLLC as paralegal and subsequently as an attorney. Ben has represented numerous financial institutions in litigation matters, bankruptcy, and landlord tenant law. He has practiced in the United States Bankruptcy Court District of MA, the Land Court, Superior, District, and Housing Courts. In December 2014, Ben, decided to leave private practice to serve the public. He currently works as the Deputy Court Administrator for Housing Court, where he works closely with the Chief Justice of the Housing Court, Timothy F. Sullivan. Ben received his Bachelor’s in Communications from the University of Buffalo, a Master’s in Business Administration from Medaille College, and a Juris Doctorate from the Massachusetts School of Law with a concentration in Real Estate Law.

Part of this event will be presented by Alec Bewsee. Alec serves on the MassLandlords Board of Directors, is a founding member of the Western Massachusetts Real Estate Investors Association, is a Certified Massachusetts Landlord Level One Provisional™, and is a managing partner of Forge Property Management based in Westfield, Mass. He received his B.S., Cum Laude, in Electrical & Computer Engineering from Western New England University in Springfield, MA before going on to support various Fortune 100 companies in the high-technology sector including United Technologies and Lockheed Martin. Alec went full time in real estate and is an experienced renovator, property manager and investor.

Part of this presentation will be given by Doug Quattrochi, Executive Director, MassLandlords, Inc. Doug was a founding member of MassLandlords in 2013. He became the association's first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to approximately 2,500 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a staggered and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.

Post: State Sanitary Code Changed

The state sanitary code defines what every apartment in Massachusetts must do and be. Unlike the building code, which is usually inspected only at time of permit completion, the state sanitary code applies in all rentals all the time, and can be inspected at any time. Did you know it changed in half a dozen major ways April 1?

Few units are fully compliant as-is. We'll review the new code in easy-to-understand detail and help you get a sense of where you may need to make repairs or improvements.

The state sanitary code is your biggest liability in a nonpayment situation, where a renter is being taken to court. They will be able to counterclaim based on the condition of the apartment. If you anticipate having any kind of conflict resolution process with a renter, it's critical that your apartment is fully up to code and your position is one of blamelessness.

This panel discussion will help us develop self-management, communication and conflict-resolution skills. We will particularly focus on high-conflict situations. We will cover:

How owners and managers can earn goodwill before drawing down on it.
"Going to the balcony" for mental separation from heated, emotionally charged tenant situations.
Phrases and approaches that de-escalate, especially where a renter escalates.
When renters threaten unnecessarily to call city inspectors or deny access to make repairs.
Identifying the time and place for simple listening vs. problem solving vs. going to court.
How to bring up difficult situations like unauthorized occupants, rent withholding, property damage, noise and nuisance and more.
Attendees will leave having been introduced to basic approaches, examples of phrases to use or avoid, and best practices for resolving difficult situations.

Part of this event will be presented by by Peter Shapiro. A graduate of MIT's Master's Program in City Planning, Peter founded and directed Mediation For Results, a Program at Just-A-Start Corporation, a nonprofit in Cambridge, Massachusetts. From 1990 to 2015, Peter and his team provided landlord counseling, mediation and homelessness prevention, and led landlord support groups across Metro Boston. Peter now provides Helpline and Member services for MassLandlords and also provides landlord counseling and mediation for the City of Boston. Peter is the author of The Good Landlord: A Guide to Making a Profit While Making a Difference.

Part of this event will be presented by Kris Snyder, member and Certified Massachusetts Landlord Level One Provisional. Kris has a professional background in customer service across several industries, including nonprofits. They are practiced at deescalation and diffusing via written communication inluding texts, chat and email. Kris also has sexual assault disclosure training via BARCC that has taught them valuable skills for making sure people feel heard and listened to when they are experiencing trauma or other stress. Kris has been a regular contributor to our members-only Facebook discussion group.

Networking time for this event will be moderated by Erin Zamarro. Erin is a real estate broker in Worcester, operating since 2008. She is a member of MassLandlords and the National Association of Realtors. Erin frequently works with buyers and sellers of multifamily or investment properties, as well as assisting property owners with rentals. She owns 8 units in Worcester.

This presentation will review our applicant qualifier in-depth.

Best practice for screening tenants includes using an applicant qualifier. This objective point-scoring system ensures that your very expensive rental property will not be rented to the wrong tenant based on "gut feel".
