Hi there, I am a real estate attorney who does a lot of easement work. First, real estate laws are specific to states, so to answer a question like this you always have to explain in which state your property is located. In general, it's a good idea to solve encroachment and easement problems as soon as affordably possible. This is because another person who is difficult could buy the nextdoor property and make your life miserable, as someone here eluded to.

There are many ways to solve this problem: You could ask the neighbor to remove the part of the drivewy on your property. You could sell that property under the driveway to the neighbor and do a lot-line adjustment (this involves hiring a surveyor and probably an attorney). You could write and record an easement giving the neighbor official control and responsibility for the maintenance of that driveway. Generally, that neighbor would pay for the easement since they are taking control of your property, even though you still have to pay property tax for it. They may say that they already have an easement because it has been there for many years. This is where you'll need to look at (or have a lawyer explain) the laws in your state to determine if this is true.

Overall, it's not a difficult problem at the moment. Somewhere down the road it could end up costing tens of thousands of dollars to remedy. So the best things to do is to try to use it as a bargaining point to get a lower price for the property now. Then, when you spend the money, you wont feel jipped.

@Jonathan Pflueger sending you and your family thoughts and prayers in this scary time. I’ve been evacuated and told my house burned down. Then told there were looters. Then told the national guard was blocking the neighborhood. None of it was true. So don’t believe anything. In the end my house survived. I hope your’s is fine too.

@Dan Lewis Hi Dan, if you’re located in CA, you have to form your entity in CA. If you form it in another state you’ll just end up paying two states’ taxes on the income and eventual capital gains. @Brandon Heath realtors don’t do lease options because that eliminates their commission. You need to go to a real estate lawyer to write the contract after the listing expires. I’m the real estate lawyer who does this for California properties. There are many ways to set LO up to suit buyers and sellers needs & protect everyone. There are quite a few potential pitfalls from law suits that need to be navigated. Feel free to PM ME.

@Wade G. it's a good question. I have always pulled equity out to buy more and keep my money working. Then, 2 years ago I bought a beach house for all cash and moved in. I experienced this peace of mind that I never knew existed from having no payments and no fears.

That nirvana was short lived when the IRS slapped me with a huge bill for selling stock. So...  I had to get a mortgage on my house to pay them. Now, I have a mortgage again. But I definietly agree with others that there is something to be said for owning things with the least amount of debt. I guess it depends on your goals, stage of life, and other sources of income.
