@Katherine Earle, the short answer is... If you want to stay on title when the refi happens, you will have an impact on the refi. The only way to really mitigate that with a bank is to bring in a credit partner who is willing to accept and guarantee your part of the deal.

However, if you can find a private individual who is looking for a long term investment, they will likely not care and do the refi without much issue.

@Cheryl Hewitt, how old is the tile? Age will help you determine if it is or not. The other thing that you should consider is whether or not you want to really know. You only have to disclose what you know. You do not have to disclose things that you suspect or think. And, the only way to know for sure is to test it. Once you test it, you may be opening a can of worms you don't want to open.

@Tadeh Vartan Ian, I have a local accountant (Tina @ https://integrityintaxllc.com) who is putting everything in our books. However, we use John Hyre (https://www.taxreductionlawyer.com) (he recently moved from Ohio to Puerto Rico to save on taxes himself) to oversee everything and make sure we're maximizing our tax deductions. John specializes in real estate investors. I absolutely love what he's helped us do. John is definitely one of the best in the industry. Can't recommend him enough. He also hold seminars in Puerto Rico that are 100% tax deductible while giving you and your family plenty of time to enjoy the island.

@Dylan Thomas, it's really a very simple problem...

There are two sides to every deal. Your perception of the seller is what got you to lose the deal. You can never lose sight of that if you want to truly be successful. We frequently buy houses at a lower price than the first and "best" offer. Taking their needs into account is critical.

When negotiating, understand there are also two parts to the process. There are price and terms. If either part takes both, it's not a deal for the other. You tried to control both. You wanted to control the price and the terms (time line). It cost you the deal.

I truly hope you learn from this and learn how to present and negotiate your offers better in the future. I'd love to hear about your success story.
