Daniel and David - I stopped getting notification on my phone for some reason, way behind on BP stuff. We have been through a few at this point. I've built a small team over the last few years and have pretty much been subbing everything out ourselves and acting as our own GC. I plan to talk with Mike who posted above, as we have some gaps that could be filled. If you need specific trades, let me know!

@Johnathan Williams - Greg is correct that @Denise Evans is the local expert on Tax Sale properties in Alabama. However, she is not a practicing attorney in the state. I too could use someone well versed (and preferably on the same page with Denise). Hopefully she can help!

@Tamika Rue - is highly suggest you talk to an attorney or at minimum look up some of Denise Evans posts on BP. You are incorrect on almost all of what you think you know and may be setting yourself up for a lawsuit. There is a lot to unpack from your post, however key points are below.

-Do not talk to the tenant if it is not the owner

- If you have a tax certificate then you can not evict, you can file an ejectment lawsuit. These are different.

- If you are trying to take possession and have talked to the owner of the property, get them to sign a lease with you, even for a $1 a month. This gives you legal possession.

- You cannot legal access the property and perform repairs or rehab u less if it abandoned. And abandoned does not mean vacant.

I strongly encourage you to study this a little more. I am not an expert, but Denise Evans has posted tons of great material on this site that you can look up.

@James Bordeaux - I really hate that this is happening to you. Unfortunately, “wholeselling” tax certificates has become somewhat popular in Birmingham. It’s sound like you are now working with an attorney, but a word of advice for anyone else looking at doing this. Some of these “wholesellers” are tying up properties that are tax sale properties from the State, then marking then up and marketing them. It sounds great to get a house for $4500! However, tax properties can be a legal nightmare. These people will tell you that you can fix these up and rent them (which isn’t a lie, but it isn’t that clear cut and dry either). Do your research on BiggerPockets. Denise Evans has written a ton about tax sale properties in Alabama. You may have never had legal rights to fix the property and most likely wouldn’t be able to sell it without clear title.

@Lorenzo Stevens - as Wayne said, the tax lien will be paid at closing. You will just need to let your end buyers know that it is there so they can account for it, or let the owner know it will come off the top of their sales price.
