My worst case scenario became a reality last night. The neighborhood HOA passed a motion to limit the number of rental properties. I just leased my home which was a primary residence last month. The max number of homes for lease is now 5%.

I believe it is wrong to make a change after I have already invested time and money into this house.  I should be grandfathered in until I decide to sell the property, not when the lease expires.

Should I try and fight this or is this a lost cause? I have another property with a HOA limit of 20%. There has been no issues there.

Why are you leasing it? Are you wanting to keep it as a rental, or were you wanting to sell it but couldn’t? 

This hasn’t passed yet but are about to vote on it.  I already have the house leased and want to keep it as a LTR. I locked in a sub 3% rate in a strong growth area.

I recently turned my primary home into a rental. However I am concerned because I received the following.

Can I fight this? If this passes, do I have a valid legal dispute?  If I purchased my primary home and then leased this home out prior to this going into effect, will I still be subject to these new rules?

the way I read the grandfather clause is that for someone like me that is already leasing the property, as soon as this lease ends, I’m subject to the new rules

It’s being proposed now.  I just moved out and leased this property this month.  I feel that I should have an exemption due to none of this being in place when I moved here or now that I am renting the property.  I have a sub 3% rate on this property and would hate to be forced into selling due to not being allowed to rent out the property
