Read your contract, but even if it is binding most agents don't like to work with off market unless they are investor-friendly. Odds are if you have an honest discussion with your agent they would be totally fine with you not using them for that transaction. Speaking as an agent if you all could work out the commissions it could be beneficial to have your agent broker the deal since this could help you avoid potential pitfalls and they should also have a team of recommended service providers that can help.
