Post: Notice to Quit in Connecituct

Hello Bigger Pockets,

I am a beginner investor in Connecticut and I had a little bit of confusion with the notice to quit. Here are some questions I have. I understand the current situation these questions does not really have a real answer, I wanted to know the answers in normal circumstances.

1. From what I know, in Connecticut the rent is late at the 9th day of the month. So if I was suppose to charge a late fees can I charge for the 10th of the month or 11th?

2. Is late fees maximum to $10 or 5% of the amount due which ever is less? If it is then is that per day?

3. what is the maximum late fees that can be charged by the landlord?

4. If the rent is due on the 1st and late on the 10th and I can not start eviction process when can I actually serve notice to quit? on 10th or 7th?

5. This one is related to the current situation. if a tenant is not able to pay the rent due to the hardship of the pandemic, can i ask for a paper proof from the tenant not having a job or cut down in their hours? does the state provide any proof that can tell me if the tenant is going through the hardship?

i just signed lease agreement with a new tenant who will be moving in end of this week. she just asked if she can add her boy friend in the lease since he is getting cable and internet on his name. the cable company is asking lease copy and wants to see his name on the lease. she said he will be in and out visiting her on regular basis. this was discussed before signing so i have no problem with that. This is not his primary residence. he has his own appt that he is renting. My question is, is it better anyways to have him on the lease as well? do i need to do application and background check on him as well?

@Filipe Pereira I am embarrassed to say I filed on 26th of July our court date is 10th of this month. I have determined that I will start eviction on the 11th in any case in future. I was just being too nice thinking that she must be going through tough time with her bank situation (I am pretty sure now that was a complete lie). But, hey you know I am learning out of every experience and I learned all the 101s of renting through this tenant which only will cost me 3 months of rent.

I am in the similar well actually worst situation and I posted similar question last month. My tenant always paid me on the 7th for first 7 months of tenancy and then started paying me on 10th and then didnt pay me for a few days in July saying her bank account was compromised and all the money was wiped out. 

I let her go for few more days and then now I am in process of evicting her. I learnt that some tenants are very smart playing this game. our lease was suppose to expire on Oct 31st. She stopped paying me since July, I assume knowing that by the time eviction process end it will be almost end of Oct (lease ending) and she will get to live for free for the month of July, August, Sept & half or almost full of Oct. 

So, from what I understand now is that rent is due on the 1st and they can be served late notice similar to one @Filipe Pereira wrote here (by the way Filipe I am gonna have to copy your letter for my future use :D ), after the 1st if the rent is not received. we can not start eviction process and can not charge late fees until the 10th day of the month in CT (to be safe 11th of the month).

hi, i am a new investor as well and investing in new haven area currently. I am also studying Hartford and i do see some opportunities of cash flowing properties around Hartford. I agree with you CT is failing state but there are opportunities around college towns(not necessarily student rental). I also see some properties in meriden, naugatuck, Waterbury area but i am scared of going there because those are old industrial towns with nothing let anymore.

without dishwasher its not luxury. I would even include dishwasher in necessity not luxury. i bought a condo to live in and there was no dishwasher. the guy who owned it was renting it and could not find tenant. the kitchen was very tight and not enough cabinet space. we redesigned whole kitchen and put dishwasher in it lived there for couple years. now i am renting it. it's my 3rd tenant there and every time i put it for rent it rents out within a week. i don't think i could if i didn't have dishwasher. bought a unit with tight cabinet space. well me and my wife lived there for couple years. there was no dishwasher when we bought it. it was very tough but we had to redesign the whole kitchen

Thanks Jose. I agree new haven is super diverse and neighborhood changes drastically every block. I have 2 rental condos in new haven. I am now looking into first multi family.
